In certain situations, the vehicle might be transferred from one person to another which would mean that the name of the owner of the vehicle in the registration certificate also has to change. The government has made the facility of transfer of ownership of the vehicle from one person to another available. There is a set procedure to do so.

There are different circumstances under which the transfer of ownership of the vehicle might happen:

  • Transfer of ownership of the vehicle in case it is purchased by someone else: In this situation, the name of the buyer has to be added in the registration certificate as the owner of the vehicle instead of the name of the previous owner.
  • Transfer of ownership in case of death of the registered owner: In this situation, the legal heir of the deceased owner has 30 days to report to the registering authority of the demise of the registered owner and his or her intention to be the owner of the vehicle. The legal heir can use the vehicle under his or her possession for a maximum period of 3 months.
  • Transfer of ownership of vehicle in an auction: In case, the vehicle is sold in an auction, the name of the new owner will replace the name of the old owner in the registration certificate of the vehicle in question.

Procedure of transfer of ownership of vehicle

The procedure for the transfer of ownership of the vehicle is different for different cases.

  • Transfer of ownership of the vehicle in case it is purchased by someone else:
  1. In case, the transfer of ownership of the vehicle is taking place because of the purchase of the vehicle by another person, Form 29 has to be submitted with all the details of the transferor and transferee.
  2. The form has to be submitted to the registering authority in the area of residence of the transferee and the transferor.
  3. If the transfer of ownership of the vehicle is occuring within the same state, the transferee has to submit Form 30 within 14 days of the transfer in addition to the documents that have to be submitted under Form 1.
  4. If the transfer of ownership of the vehicle is occuring outside the state, the transferee has to submit Form 30 within 45 days of the transfer in addition to the documents that have to be submitted under Form 1 and Form 2.
  5. The transferee also has to pay the charges levied by the registering authority under Rule 81 of the Central Motor Vehicle Rules 1989.
  • Transfer of ownership if the owner of the vehicle is deceased:
  1. The new owner of the vehicle has to submit Form 31 to the registering authority by filling all the details that have been asked in the form.
  2. The new owner of the vehicle should submit the form for the transfer of ownership within 3 months of taking actual ownership of the vehicle.
  3. The new owner of the vehicle has to make the payment for charges levied by the registering authority for transfer of ownership of the vehicle under Rule 81 of the Central Motor Vehicles Rules, 1989.
  • Transfer of ownership of vehicle in an auction:
  1. If the vehicle is purchased at a Central or State Government sponsored auction, the application for the transfer of ownership has to be submitted via Form 32.
  2. The form should be submitted to the registering authority within 30 days of purchase of the vehicle.
  3. The new owner of the vehicle has to make the payment for charges levied by the registering authority for transfer of ownership of the vehicle under Rule 81 of the Central Motor Vehicles Rules, 1989.

Documents required for transfer of ownership

  • Transfer of ownership of the vehicle in case it is purchased by someone else: For the transfer of ownership of a vehicle via a normal sale, the documents required are:
  1. The application (Form 29) through which the transfer of ownership can be applied via a normal sale.
  2. Form 30.
  3. In addition to Form 30 and Form 31, Form 1 and Form 2 are also required.
  4. The documents to be submitted under Form 1 and Form 2 are:

Form 1

  1. Registration certificate of the vehicle.
  2. Insurance certificate of the vehicle.
  3. A certificate that verifies the pollution emitted by the vehicle being under control.
  4. PAN card of the new owner of the vehicle and Form 60.
  5. Chassis and Engine pencil print of the vehicle.
  6. A document that acts as proof for the date of birth of the owner of the vehicle.
  7. A document which acts as proof for the address of the owner of the vehicle.
  8. The R.C. book of the vehicle.
  9. Purchaser’s undertaking.
  10. Passport size photographs of the owner of the vehicle.
  11. The certificate which states that the tax for the vehicle has been cleared.

Form 2

  1. The owner of the vehicle has to submit a No Objection Certificate that has been obtained from the concerned registering authority.
  2. A document which states the refusal from the concerned registering authority to provide a No Objection Certificate if that is the case.
  3. If the owner of the vehicle has not received the No Objection Certificate from the concerned authority, he or she has to provide proof for not receiving the same by producing the following documents:
  1. The receipt from the concerned registering authority or
  2. The receipt from the post office of the No Objection Certificate received from the registering authority.
  • Transfer of ownership if the owner of the vehicle is deceased:
  1. Form 31.
  2. Registration certificate of the vehicle.
  3. Insurance certificate of the vehicle.
  4. Death certificate of the owner of the vehicle who is now deceased.
  5. A certificate that verifies the pollution emitted by the vehicle being under control.
  6. PAN card of the new owner of the vehicle and Form 60.
  7. Chassis and Engine pencil print of the vehicle.
  8. A document that acts as proof for the date of birth of the new owner of the vehicle.
  9. A document which acts as proof for the address of the new owner of the vehicle.
  10. The R.C. book of the vehicle.
  11. Passport size photographs of the new owner of the vehicle.
  12. A document stating that the new owner’s linkage to the deceased owner.
  13. Signature identification of the person who sold the vehicle.
  14. Form 20 needs to be submitted. It contains details about the verification of the vehicle.
  • Transfer of ownership of vehicle in an auction:
  1. Form 32.
  2. Registration certificate of the vehicle.
  3. Insurance certificate of the vehicle.
  4. A certificate that verifies the pollution emitted by the vehicle being under control.
  5. PAN card of the new owner of the vehicle and Form 60.
  6. Chassis and Engine pencil print of the vehicle.
  7. A document that acts as proof for the date of birth of the owner of the vehicle.
  8. A document which acts as proof for the address of the owner of the vehicle.
  9. The R.C. book of the vehicle.
  10. Purchaser’s undertaking.
  11. Passport size photographs of the owner of the vehicle.
  12. The certificate which states that the tax for the vehicle has been cleared.
  13. A certificate which states that the vehicle has been sold to the new owner in an auction conducted by the Central or State Government.
  14. A certificate which states that the auction has been conducted by the State or Central Government.
